Sales Agreement
Deposits
A Non Refundable deposit of $300.00 is required to hold your pick

Buyer understands that once a deposit is made it is a commitment to buy a puppy and is therefore non-refundable.

Deposits will be made once the litter is 1 week old from date of birth.

Should a deposit be placed before the litter is born and the breeding does not take, or does not produce enough pups to accommodate all reserved picks, the Buyer may transfer their deposit to another breeding only. In most cases a repeat attempt at the same breeding on the next heat cycle.

Deposit payments can be made by money order, *PayPal, *wire transfer, or cash.

*Deposits, or payments, made through PayPal will have 4% added to cover fees. An invoice will be sent for this transaction.

*Wire transfers will have an additional $30.00 to cover bank transfer fees.

Payments
-
The remaining balance is due in FULL to the Seller by, or before, the puppy is 8 weeks of age. If the balance due is not paid by the specified date in the Sales Agreement, Buyer will forfeit any monies paid to date, and said puppy may be then re-sold.

Puppies purchased at, or after 8 weeks of age, must be paid in full at the time of sale.

Selection Picks
Selections, or picks, will be made between 7-8 weeks of age.

Buyer understands the picks are made in the order by which the deposits were received.

The buyer is NOT entitled to a refund of any monies paid if another person, or the breeder, selects the puppy the Buyer wanted using their pick.

The Buyer agrees to select from the remaining puppies available at the time of their pick.

The Buyer may transfer their deposit to another litter, if available, but not guaranteeing the same priority of pick.

Buyer agrees to make their pick in a timely manner. The seller will allow 48 hours to make their pick. Seller agrees to provide pictures and videos on a weekly basis at the request of the Buyer.

Buyer understands the Seller will do, to the best of their ability, match the best possible puppy based on the needs and want of the Buyer.

Buyer understands that the Seller can NOT guarantee any specific color, color pattern, or amount of color available in each litter. The Buyer is NOT entitled to a refund of any monies paid should they not want any of the pups available at their pick because of color thereof.

Buyer understands that the Seller can NOT guarantee that all pups will be born to have a full tail. Some pups may be born with a short, or kinked tail, which is common to the breed, In those instances, the tail will be docked.

Puppies will NOT leave the Seller’s possession before 8 weeks of age. NO EXCEPTIONS.

The puppy is to be picked up, or shipped by 10 weeks of age. Unless prior arrangements are made with the Seller, or the Buyer forfeits all monies paid, and the puppy can be re-sold. Exception: Puppies being shipped internationally cannot be shipped before 12 weeks of age.

Shipping

If you will need your puppy shipped Buyer agrees to notify Seller at the time of the deposit.

Shipping fees, crate, and health certificates are in addition to the cost of the puppy.

Buyer understands that the Seller does NOT warranty pups while being transported. Seller has no control over the care, or handling during transport. Please note that shipping is at the Buyers risk.

The Seller is willing to drive within a (2) hour radius to deliver your fee for no additional cost. We may consider driving further at the cost of expenses including fuel and lodging.

IT IS HEREBY AGREED BY BOTH PARTIES THAT THE FOLLOWING CONDITIONS WILL BE MET AND THAT NO OTHER WARRANTIES OR CONDITIONS ARE EXPRESSED OR IMPLIED.

Seller guarantees that the American Bulldog puppy being sold is the offspring of the listed Sire and Dam, and is free of communicable diseases as appears to the eye at the time of the sale. Said puppy will be current on de-worming and vaccinations appropriate to the age of the puppy when it leaves possession of the seller.

Buyer agrees to provide regular veterinary care including check-ups, booster vaccinations, and any other care needed by the dog (e.g. regular worming, illnesses, injuries, etc.)

Buyer certifies that he/she is not acting as an agent for another individual in the purchase of this puppy, and will NOT sell this puppy to any mass-producing kennel(puppy mill), or business.

Buyer promises to keep the puppy in a proper manner and provide appropriate care and socialization. Said puppy shall not be kept permanently in a crate, or in a small confined area where it is unable to achieve proper exercise and socialization needed for the health and well-being of the puppy.

Buyer agrees to keep in close contact with the seller for the life of the puppy including occasional updates and pictures showing the growth, development, and well-being of said puppy.

If at some point the Buyer decides to sell the puppy, the Seller is to be given the first option to buy back said puppy at no more than the Buyer’s original purchase price. If the Seller declines the option to buy back said puppy, the Buyer agrees to notify Justin McKee of CenterBull Kennel as to the whereabouts of said puppy. (Note: 1 year health guarantee is non-transferable and applies only to the original part listed in the Sales Agreement.)

Buyer agrees to NEVER surrender said puppy to any shelter, or rescue. If the Buyer is unable to keep said puppy for any reason, the Seller is to be notified immediately so that we may make arrangements to get said puppy back. Under a surrender situation the Buyer is NOT entitled to any monetary compensation. We will pay for transport fees to receive said puppy and the Buyer will have no responsibility to pay transportation fees. Once the dog is surrendered to us, CenterBull Kennel, all rights to that dog are relinquished by the Buyer.

Buyer understands that all the pups are sold with no breeding rights unless noted otherwise. It is required to spay/neuter the puppy no later than 2 years old, and forward proof of the procedure with a letter from the Veterinarian to CenterBull Kennel.

Should the buyer purposefully, or accidentally, breed the puppy at any point in the dog’s life under limited registration, it will result in legal action at the expense of the buyer and an immediate monetary fine of $2500.00. Penalties to be paid to Justin McKee of CenterBull Kennel.

Buyer understands that breeding rights may be retained on SELECT males for a maximum of 36 months. After 36 months, the spay/neuter portion of this agreement is to be upheld by the Buyer.

2 Year Health Guarantee
PLEASE NOTE: Failure to comply will VOID the Health Guarantee

At the expense of the Buyer, this puppy should be examined by a veterinarian within 72 hours of possession to VALIDATE the Health Guarantee. A copy of the Health Exam from the Buyer’s Veterinarian, dated no more than 72 hours from the date of possession, MUST be emailed/mailed to the Seller immediately following the exam, or the Guarantee is VOID. If a hard copy of the exam is not received within 14 days of the date of possession from the Seller, the Guarantee is VOID.

Should said puppy be found to be in ill health, the cause of which is clearly attributable to the Seller, the puppy may upon a written conclusive diagnosis from a veterinarian, be returned to the Seller for another puppy of equal value when available. Return shipping is the responsibility of the Buyer. Shipping cost for the replacement puppy will be the responsibility of the Seller.

Seller guarantees for one year from the Date of Sale that said puppy is free from any congenial defects, or illnesses related to the following conditions: Hips (DJD only), knees, elbows, heart, kidneys, thyroid, and neurological disorders. Wry jaw/face is only warrantied if the condition affects the dog’s ability to eat, or drink properly. Maloculusions, missing teeth, or extra teeth are NOT covered under the warranty as these do not affect the health of the dog.

There MUST be a conclusive diagnosis in writing from the Buyer’s veterinarian before a replacement puppy will be offered. A speculative, or inconclusive diagnosis will NOT warrant a replacement puppy from the Seller.

The Buyer and Seller may mutually agree that the effected puppy can be spay/neuter and placed in an appropriate pet home at the Buyer’s expense. Proof of spay/neuter and all original registration documents must be provided to the Seller in order to receive a replacement puppy.

If, in the unfortunate case, that the quality of life of said puppy is severely affected, the Seller asks that the puppy be humanely euthanized by a veterinarian. Written and conclusive diagnosis, along with a description of the puppy and its registration documents be returned to the Seller before a replacement puppy will be offered. Shipping cost will be the responsibility of the Seller.

If the Buyer chooses to keep an affected puppy they may do so. Buyer must spay/neuter the puppy and provide Written and conclusive diagnosis, along with a description of the puppy and its registration documents be returned to the Seller. In this case the Seller will offer the option to purchase another puppy with a credit of half of their original purchase price towards another puppy of the same value.

In case of sudden/unexpected death a necropsy must be performed at the Buyers expense. A written and conclusive diagnosis stating the cause of death related to a congenital defect, or illness, as listed above must be returned along with a copy of the necropsy report, and the original registration documents before a replacement puppy will be offered. Shipping costs will be the Sellers responsibility.

Buyer understands and agrees that the Seller shall not be responsible for reimbursement, or payment of any medical expenses related to said puppy. Buyer assumes responsibility for all care including veterinary expenses.

Buyer understands that NO REFUNDS WILL BE GIVEN for any reason other than those stated in this agreement.

Seller reserves the right to verify any information provided by the Buyer with the Buyer’s Vet.

Buyer understands that the replacement puppy may NOT be from the same parents as the original breeding. If you are entitled to a replacement puppy, we would be happy to discuss our breeding plans for the next 24 months to determine the best breeding for you to receive your replacement from.

Buyer also understands that a replacement puppy must be taken within 24 months from the time the replacement was warranted from the Seller. If Buyer chooses not to take a replacement within 24 months, the Buyer agrees to forfeit all monies paid and any entitlement to a replacement.

Buyer releases Justin McKee of CenterBull Kennel, and their estate from any and all liabilities, and, or damages by fault of this dog after the date of sale.
THIS AGREEMENT IS VOID:

If we, the Seller, find out that you have abused the pup in any way, basic care was not provided, if you weight pull the pup before the age of 1, if the pup has been involved in an accident, involved in a dog fight, has been bred/studded out before the age of 1, or is sold/given to another party not listed in the Original Sales Agreement.

Any alterations to the pup after it leaves possession of the Seller such as ear cropping or tail docking. These are very painful elective surgeries that we do NOT condone. Note: Pups sold with docked tails are covered under the Guarantee.

Also, if we the Seller, find out that we were lied to in any way in regards to the purchase of the said puppy, your Guarantee will be VOID and registration will be revoked.
IMPORTANT PLEASE READ:
Seller reserves the right to cancel the sale of the puppy at any time for any reason. If the seller chooses not to sell said puppy, all monies paid including deposit, will be returned to the Buyer.
